This category includes the various forms of so-called ADR (alternate dispute resolution) practitioners, such as GALs, parenting coordinators, parenting evaluators, forensic psychologists, recommending mediators, special masters, court-ordered therapists, other court-appointed mental health professionals, supervised visitation centers, and other profiteers of "therapeutic jurisprudence", whose methods involve -- in non-criminal cases -- intrusion and coercion under the threat of court sanctions, and actual or de facto extra-judicial decision-making. This website heavily criticizes all of these practices, which have multiple things wrong with them, not the least of which is denigration of due process, and the diminution of a publicly observable, regulated, and appealable "rule by law" by substituting the caprice of men and women. These practices have been promoted as "cures" for ailings of the court system and the litigants in it by self-serving persons who apparently are ignorant, or else just do not care about the harms they cause to children and their parents because they make money from the ideas they promote, churning profit in proceedings that fly in the face of the foundations of our justice system. Research "Myths and Facts" pages<br />
These pages, and the pages on custody evaluation and the joint custody, contain literally thousands of research citations. The sociological and psychological research on families and child well-being impacts public policy and the issues of child custody in family law. The research frequently is misrepresented, and mis-cited by mental health professionals, lawyers, forensic psychologists and others, as well as interest groups lobbying for laws. The "facts" on the research myths and facts pages refer to the "fact" of the actual research findings. Often what is cited instead is the "spin" or speculation in researchers' writeups. These pages are presented as a commentary on the flimsy rationales (of record) given for much of current public policy. Also review the other sections pertaining to the issues impacted by the research, such as child custody, parental alienation theory, and other family law issues, as well as the section on therapeutic jurisprudence, which in the family courts is economic opportunism (not science) under the pretext that engineering family affectional relationships is within the ability of mental health "science" to accomplish (this is misrepresentation), and moreover, that it is an appropriate goal of the government and court system using the specious rationale that these interventions are necessary or helpful for children's wellbeing (while ignoring the many iatrogenic effects on both families and the over-burdened courts).Also see subsection on Child Custody in FAMILY LAW<br />
# Critique of Kelly and Lamb Infant Overnight "research" literature by liz CITATIONS TO RESEARCH<br />
This paper is used as a teaching illustration of how to do critical reading, and of how the research is distorted and misrepresented in the sociology and psychology literature. It is a line-by-line analysis of propaganda techniques, logic errors, and outright fraud. The Lamb and Kelly article is presented in its entirety, interlineated with discussion and commentary, as well as annotations. The widely-cited paper, Using Child Development Research to Make Appropriate Custody and Access Decisions for Young Children (2000), is an example of pseudo-science posing as objective scholarship by "researchers" or "scientists".But it's a political position paper advocating (without sound basis for doing so), for joint custody for babies and very young children.<br />

This section of the website contains current public material from on-going research being conducted around the United States and in Canada by various scholars and organizations who are sharing findings, as well as links to articles and off-site locations on the issue of the harmful use of psychology and psychological theories in the family court systems. Therapeutic jurisprudence in the family courts, i.e. a "mental health approach to the law" substitutes the opinions of mental health practitioners for traditional evidence and decision-making procedures. Because these persons actually do not have any kind of "expertise" to opine this way, what originally was thought to be a helpful idea (in this medicalized and psychologized world) has become merely economic opportunism, harming not only the litigants and children in the system as well as the court system itself, but also perverting substantive and procedural law. It is not science, but compensated yenta-ism that has permeated the courts under the pretexts that engineering family affectional relationships is within the ability of mental health "science" practitioners to accomplish, and that this is an appropriate goal of the government, court system, and state police power because children "need" something it has to offer. Brett's Carrel: Women and Religion<br />
This section includes bits and snippets of information relevant to religion and women, both on-site, and recommended off-site links. Atheism is the primary focus, because, among other things, it represents the ultimate rejection of the demands of religious teachings and moral traditions, most of which are based on a quasi-governmental purpose that includes control of the population. Such control manifests not only in moral teachings and exortations (supplementing the sovereign laws), but also in the religion's rituals, concepts about family, and restrictions on the education and sexual behavior of women (mostly), as well as dictates of appropriate child-rearing practices. At times religion has become extreme in the measures used in defense of its own perpetuation, e.g. the Witch Craze of the Middle Ages, or the religious Jihad or puninitve Sharia laws of today. At other times religion functions, either as the government or with the landed government, in more subtle but just as powerful, ways. Those who wish to control the population (the sovereign, the religious leaders, or those otherwise in positions or power and privilege) seek to control women in ways differently from men because women control reproduction, the greatest societal resource, and -- in the absence of such control over women -- women would control their offspring. (These lessons are throughout the Old Testament, e.g. King Solomon.) In a patriarchal culture, not controlling mothers -- in large part accomplished by and through religion and its moral teachings (e.g. submission to marriage in husband-headed families) -- could conceivably result in the overthrow the power structure within a generation or two. By contrast, war, patriotic rhetoric and military service historically control the sovereign's male population. Loyalty in that service to the sovereign -- typically barred to women -- is rewarded for those who survive with property, ownership power over family members and servants, and often some measure of citizenship participation. This in turn is how the sovereign subdues, orders and controls its armies and labor force, the potentially dangerous and rebellious male population. (In more recent times, psychology, drugs, pornography -- woman ownership -- and consumerism substitute in part for traditional patriarchal religion in keeping the labor force subdued and beholden to the company store.) Woman Suffrage in the United States; Woman Suffrage Timeline<br />
The timeline in this section includes the little known -- and usually omitted -- dates when women first LOST their voting rights in the United States following the Declaration of Independence. Previously, voting rights were based on land ownership, not sex, and while most women suffered a chattel-like status as minors or wives under control of fathers, guardians, and husbands (thus not owning land or exercising full citizenship rights) some unmarried women heirs and widows without sons were able to vote and contract because they did not have these "protectors". It’s a poster intended to inform children of their rights and, as such, is great for anyone. The language it uses is important, too. It shows the extent to which the world of children’s rights has moved on since the Universal Declaration on Children’s Rights. Then, the version written for children has them as passive dependants. In this version children are active agents, following the spirit of the CRC itself.<br /><br />
Here is the text from the poster. The numbered points correspond to the articles in the convention:<br /><br />
<strong>1) Everyone under the age of 18 has ALL of these rights. You have the right to…<br /><br />
2) Be treated fairly no matter who you are, where you are from, what language you speak, what you believe or where you live.<br /><br />

</div>My search today for ‘United Nations Child Rights’ yielded <a href="http://www.eric.ed.gov/ERICWebPortal/Home.portal?_nfpb=true&ERICExtSearch_Operator_2=and&ERICExtSearch_SearchType_0=kw&ERICExtSearch_SearchValue_2=&ERICExtSearch_SearchValue_1=child+rights&ERICExtSearch_Operator_1=and&ERICExtSearch_SearchType_1=kw&ERICExt">257 documents</a> in the ERIC database that represent global action and thought on the topic.<br /><br />
When I added United States of America into the search, <a href="http://www.eric.ed.gov/ERICWebPortal/Home.portal?_nfpb=true&ERICExtSearch_Operator_2=and&ERICExtSearch_SearchType_0=kw&ERICExtSearch_SearchValue_2=&ERICExtSearch_SearchValue_1=child+rights+united+states+america&ERICExtSearch_Operator_1=and&ERICExtSearch_S">3 documents</a> appeared. Only one 1991 document “is a <a href="http://www.eric.ed.gov/ERICDocs/data/ericdocs2sql/content_storage_01/0000019b/80/13/2a/09.pdf">curriculum</a> that serves as an introduction to the United Nations Convention on the Rights of the Child. Designed for the upper elementary and middle grades 5-10.”<br /><br />
I took out ‘America’ and received information on <a href="http://www.eric.ed.gov/ERICWebPortal/Home.portal?_nfpb=true&ERICExtSearch_Operator_2=and&ERICExtSearch_SearchType_0=kw&ERICExtSearch_SearchValue_2=&ERICExtSearch_SearchValue_1=child+rights+united+states+&ERICExtSearch_Operator_1=and&ERICExtSearch_SearchTy">32 documents</a>, all of which are not specifically about our nation.<br /><br />
Our nation will never begin to bring a discussion of child rights into mainstream educational classrooms as long as we continue to allow <a href="http://www.google.com/#hl=en&source=hp&q=corporeal+punishment++schools&aq=f&aqi=g-sx3&oq=&fp=be5ffa94030d2d34">corporeal punishment</a> to exist within our schools. Physical assault, violence and ‘hitting’ by public school staff is still <a href="http://school.familyeducation.com/classroom-discipline/resource/38377.html">legal in 22 of our 50 states</a>:<br /><br />

</div>The focus of my blog is on the intergenerational transmission of unresolved trauma that happens because the Rights of Children are not protected. Our problem is much larger than corporeal punishment in our schools. I understand that the sinking Titanic of Dark Age thinking within the current medical model field of mental health services and research remains connected to our public consideration of Child Rights on all levels within our nation, including in our laws, in our homes, and in our public educational system.<br /><br />
The following is included in the <a href="http://www.cirp.org/library/ethics/UN-convention/">Preamble to the United Nations Convention on the Rights of the Child</a>:<br /><br />
“<em>Recalling that, in the Universal Declaration of Human Rights, the United Nations has proclaimed that childhood is entitled to special care and assistance,</em><br /><br />
<em>Convinced that the family, as the fundamental group of society and the natural environment for the growth and well-being of all its members and particularly children, should be afforded the necessary protection and assistance so that it can fully assume its responsibilities within the community,</em><br /><br />
<em>Recognizing that the child, for the full and harmonious development of his or her personality, should grow up in a family environment, in an atmosphere of happiness, love and understanding,</em><br /><br />
<em>Considering that the child should be fully prepared to live an individual life in society, and brought up in the spirit of the ideals proclaimed in the Charter of the United Nations, and in particular in the spirit of peace, dignity, tolerance, freedom, equality and solidarity…</em>”<br /><br />
In the spirit of the aims of this blog, I am particularly concerned that children within our nation experience every possible assistance toward “the full and harmonious development of his or her personality” which can only happen through safe and secure attachment experiences that an infant-child has provided for it “in an atmosphere of happiness, love and understanding” that happens ONLY when Child Rights are recognized, allowed and protected.<br /><br />
We are not clear as a nation or as individuals about what Child Rights are. <a href="http://www.crin.org/resources/infoDetail.asp?ID=21300&flag=report">CRIN’s Factsheet on Children’s Rights</a> clearly describes the ONLY way to look at the Universal Rights of Children. The USA is a nation of materialists. We must still believe that children are possessions, and therefore believe that children are not HUMAN, they are OBJECTS to be arbitrarily treated in any way we want to – within the boundaries of our laws, which are obviously themselves seriously lacking in regard to the Universal HUMAN Rights of Children.<br /><br />
Is our nation acceptably divided about whether or not children are human beings or not? I think that is the issue here. If we believe in the Dark Age thinking that children are possessions and are therefore objects rather than human beings, anything we might assign to them in terms of a ‘right’ or not can remain arbitrary. I have no illusions about this point, <a href="http://stopthestorm.wordpress.com/the-devils-child-my-childhood/vignettes-from-my-abusive-childhood/age-13-dirty-diaper-and-pepples-in-my-knees/">personally</a>.<br /><br />
When my mother and my grandmother engaged in a <a href="http://stopthestorm.wordpress.com/the-devils-child-my-childhood/vignettes-from-my-abusive-childhood/cindy-born/">rage-filled argument</a> over little not quite two-year-old me, it was because they believed I was an object possession, not that I was a human child.<br /><br />
When my mother violently <a href="http://stopthestorm.wordpress.com/the-devils-child-my-childhood/vignettes-from-my-abusive-childhood/the-toilet-bowl/">shoved my three-year-old head repeatedly into the toilet bowl</a> and beat me mercilessly, I was not being treated as a human being with rights. I was being treated more aggressively than if I was a baby’s dirty diaper.<br /><br />
When I was battered and terrorized and forced to spend the night sitting perched on a stool alone in the dark because <a href="http://stopthestorm.wordpress.com/the-devils-child-my-childhood/vignettes-from-my-abusive-childhood/age-6-childhood-stories-aug-1957-through-sept-1958/first-grade-night-on-the-stool/">I got the white cuffs of my parka dirty</a>, I was treated as having LESS VALUE and less rights than the coat did!<br /><br />
When I was made to ride long hours in the car curled in a fetal position on the floor of the back seat ‘<a href="http://stopthestorm.wordpress.com/the-devils-child-my-childhood/vignettes-from-my-abusive-childhood/age-7-childhood-stories-sept-1958-through-aug-1959/age-7-mud-puddle-incident/">like a dog’</a> when I was seven, I was treated as having less value and rights than a badly abused dog!<br /><br />
When I was 13 and knocked down by my mother over and over again into a <a href="http://stopthestorm.wordpress.com/the-devils-child-my-childhood/vignettes-from-my-abusive-childhood/age-13-dirty-diaper-and-pepples-in-my-knees/">giant mud puddle</a> until I crawled around and said over and over again, “I am a pig, I am a pig,” which I refused to do, I was being treated with less value and as having no more rights than would a badly abused livestock animal.<br /><br />

</div>I realize that I am taking a controversial stand, but believe me, the suffering of the 18 years of my infant-childhood — and the resulting suffering during my entire adult life as a consequence of the violation of my Rights as a Child – backs me up when I say to everyone in our nation: You either stand on the side of knowing absolutely that children are human beings with Universal Human Rights that must be guaranteed and protected, or you do not and believe instead that children are not human and are objects that are possessions with no HUMAN rights at all.<br /><br />
It is this latter position held by the majority of our citizens that prevents every one of our 50 states, and therefore prevents our entire nation, the United States of America, from ratifying the United Nations <a href="http://www.cirp.org/library/ethics/UN-convention/">Convention on the Rights of the Child</a> and from guaranteeing these rights be protected for every American child.<br /><br />
I am sorry, but I cannot find any ‘gray area of the Law’ here. “Clarity Begins At Home.” Our ignorance belongs to us. As long as we deny our beliefs that children are objects, possessions and livestock, we will remain a nation of child abusers on our most fundamental level, because we do not REALLY believe that children are human beings at all, and therefore have no Universal Human Rights to be either guaranteed or protected.<br /><br />
How else can I understand how I could go to public 8th grade PE class wearing one of those little blue gym suits with the entire back of my body covered solid with bruises of every imaginable color and shape all the way down to my heels — black, blue, green, purple, yellow, brown — from the base of my neck, across both of my shoulders and arms, down my back, over my buttocks, down my thighs, my calves — all perfectly visible to those around me on the gymnasium floor and/or in the community girls’ showers? Nobody blinked an eye or EVER said a WORD!<br /><br />
That was in 1964. How much progress have we <em><span style="text-decoration: underline;"><strong>REALLY </strong></span></em>made since then in recognizing and protecting the Universal Human Rights of our nation’s children? Where are our laws that tell our children and the world we mean exactly what we say?<br /><br />

This legislation, called the Violence Against Women Act (VAWA), recognized that "violence against women is a crime with far-reaching, harmful consequences for families, children and society" (Domestic and Sexual Violence Data Collection, A Report to Congress under the Violence Against Women Act, 1 [NIJ Research Report 1996]). To combat this violent crime problem, VAWA created federal domestic violence crimes to be prosecuted by the Department of Justice. Consistent with this federal initiative, the Crime Bill also amended the Gun Control Act to include domestic violence-related crimes. Congress reaffirmed its commitment to fight domestic violence crimes by the enactment in the fall of 1996 of additional federal domestic violence crimes in both VAWA and the Gun Control Act.</p><br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">Historically, the federal government has generally lacked jurisdiction over many domestic violence crimes. These crimes, however, pose a serious problem in our communities. Accordingly, while domestic violence remains primarily a matter of state and local jurisdiction, both VAWA and the Gun Control Act provide federal tools to prosecute domestic violence offenders in certain situations involving firearms or interstate travel or activity.</p><br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">This chapter provides a concise summary of the federal offenses/statutes now available in both VAWA and the Gun Control Act to prosecute domestic violence offenders in the federal courts. It also provides a summary of selected prosecutions under each statute and a checklist of offenses. These statutes strive to achieve the Congressional goal to "treat violence against women as a major law enforcement priority, take aim at the attitudes that nurture violence against women, and provide the help that survivors need" (S.Rep. No. 102-197, at 34-35, 1991). Through enforcement of these available laws, the Department of Justice can and will assist state and local jurisdictions in their efforts to combat domestic violence.<br /><br /></p>The Violence Against Women Act<a title="id2356775" name="id2356775" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Interstate Travel to Commit Domestic Violence, 18 U.S.C. § 2261<a title="id2352369" name="id2352369" style="color: rgb(12, 115, 158); text-decoration: none; "></a>18 U.S.C. § 2261(a)(1)<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">It is a federal crime for a person to travel interstate (or to leave or enter Indian country) with the intent to injure, harass, or intimidate that person's intimate partner when in the course of or as a result of such travel the defendant intentionally commits a violent crime and thereby causes bodily injury. The law requires specific intent to commit domestic violence at the time of interstate travel. The term "intimate partner" includes a spouse, a former spouse, a past or present cohabitant (as long as the parties cohabitated as spouses), and parents of a child in common. The intimate partner definition does not include a girlfriend or boyfriend with whom the defendant has not resided unless protected by state law. There must be bodily injury for prosecution under this statute.</p><a title="id2352383" name="id2352383" style="color: rgb(12, 115, 158); text-decoration: none; "></a>18 U.S.C. § 2261(a)(2)<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">It is also a federal crime to cause an intimate partner to cross state lines (or to leave or enter Indian country) by force, coercion, duress, or fraud during which or as a result of which, there is bodily harm to the victim. This subsection does not require a showing of specific intent to cause the spouse or intimate partner to travel interstate. It does, however, require proof that the interstate travel resulted from force, coercion, duress, or fraud. As in subsection 2261(a)(1), the defendant must intentionally commit a crime of violence during the course of or as a result of the travel and there must be bodily injury to the spouse or intimate partner.</p><a title="id2360591" name="id2360591" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Interstate Stalking, 18 U.S.C. § 2261A<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">As of September 23, 1996, it is a federal crime to cross a state line with the intent to injure or harass another person, if in the course of or as a result of such travel, the defendant places such person in reasonable fear of the death of, or serious bodily injury to, that person or a member of that person's immediate family. The law requires specific intent to violate this subsection at the time of interstate travel. "Immediate family" includes a spouse, parent, sibling, child, or any other person living in the same household and related by blood or marriage. It is also a federal crime to "stalk," as it is defined in Section 2261A, within the special or maritime jurisdiction of the United States. This includes Indian reservations and military bases.</p><a title="id2354037" name="id2354037" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Interstate Travel to Violate an Order of Protection, 18, U.S.C. § 2262<a title="id2354047" name="id2354047" style="color: rgb(12, 115, 158); text-decoration: none; "></a>18 U.S.C. § 2262(a)(1)<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">This law prohibits interstate travel (or travel into and out of Indian country) with intent to violate a valid protection order that forbids credible threats of violence, repeated harassment, or bodily injury. To establish a violation of this statute, the Government must demonstrate that a person had the specific intent to violate the protection order at the time of interstate travel and that a violation actually occurred. This statute does not require an intimate partner relationship--although this relationship may be required by the state or other governmental body issuing the order--nor does it require bodily injury.</p><a title="id2354062" name="id2354062" style="color: rgb(12, 115, 158); text-decoration: none; "></a>18 U.S.C. § 2262(b)(1)<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">It is also a federal crime to cause a spouse or intimate partner to cross state lines (or leave or enter Indian country) by force, coercion, duress, or fraud during which or as a result of which, there is bodily harm to the victim in violation of a valid order of protection. This subsection does not require a showing of specific intent to cause the spouse or intimate partner to travel interstate. It does, however, require proof that the interstate travel resulted from force, coercion, duress or fraud. The Government must also prove that a person intentionally injured an intimate partner in violation of a protection order during the course of or as a result of the forced or coercive travel. This subsection, unlike corollary Section 2262(a)(1), requires an intimate relationship between the parties.</p><br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">The Department of Justice recognizes that under both § § 2262(a)(1) and (a)(2), law enforcement may be unable to verify the validity of a protection order at the time of arrest. The national data center from which law enforcement and prosecutors will be able instantaneously to verify protection orders will be of enormous benefit to federal authorities in the prosecution of criminal cases under Section 2262. Until such time as this registry is in place and fully operational, law enforcement should consult with the U.S. Attorney in their district for guidance in these cases.</p><br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">To assist in prosecution under Section 2262 it is necessary to examine the protection orders currently issued in the relevant jurisdiction. For example, in Maine, the Protection-from-Abuse Order did not conform to the language of Section 2262 and made no provision for a judicial finding that the defendant posed a credible threat of violence, repeated harassment, or bodily injury. To correct this statutory deficiency, the U.S. Attorney's Office in the District of Maine, with the support of key members of the state legislature, proposed legislation that would bring the State into conformity with the VAWA provisions. The legislation received no opposition and passed the Legislature on May 30, 1997. The law went into effect on September 19, 1997.</p><a title="id2355665" name="id2355665" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Penalties<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">Penalties for violations of Sections 2261, 2261A, and 2262 hinge on the extent of the bodily injury to the victim. Terms of imprisonment range from 5 years for bodily injury to life if the crime of violence results in the victim's death.<br /></p><br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; "><br /><br /></p>Firearm Offenses<a title="id2354833" name="id2354833" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Possession of Firearm While Subject to Order of Protection, 18 U.S.C. § 922(g)(8)<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">It is illegal for a person to possess a firearm while subject to a court order restraining such person from harassing, stalking, or threatening an intimate partner or the child of an intimate partner. The protection order must have been issued following an evidentiary hearing in which the defendant had notice and an opportunity to appear. The protection order must also include a specific finding that the defendant represents a credible threat to the physical safety of the victim, or must include an explicit prohibition against the use of force that would reasonably be expected to cause injury. The statutory language of Section 922(g)(8), in addition to the language of Section 2262, provides additional justification for review of a jurisdiction's protection order form to determine if they conform with the federal requirements. Again, refer any questions about the applicability of this statute to the United States Attorney's Office in that district.</p><a title="id2355675" name="id2355675" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Transfer of Firearm to Person Subject to Order of Protection, 18 U.S.C. § 922(d)(8)<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">It is also illegal to transfer a firearm to a person subject to a court order that restrains such person from harassing, stalking, or threatening an intimate partner or the child of an intimate partner. A violation of Section 922(d)(8) must be knowing. Proof concerning knowledge on the part of the supplier may be difficult to establish absent a fully operational central registry for protection orders.</p><a title="id2354955" name="id2354955" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Official Use Exemption, 18 U.S.C. § 925<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">The restrictions of Sections 922(d)(8) and (g)(8) do not apply to firearms issued by governmental agencies to a law enforcement officer or military personnel so long as the officer or military personnel is on duty. Personal firearms do <em>not</em> fall within this exemption nor may these personnel possess officially issued firearms when off duty.</p><a title="id2354981" name="id2354981" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Possession of Firearm After Conviction of Misdemeanor Crime of Domestic Violence, 18 U.S.C. § 922(g)(9)<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">As of September 30, 1996, it is illegal to possess a firearm after conviction of a misdemeanor crime of domestic violence. This prohibition applies to persons convicted of such misdemeanors at any time, even if the conviction occurred prior to the new law's effective date. A qualifying misdemeanor domestic violence crime must have as an element the use or attempted use of physical force or the threatened use of a deadly weapon. For example, a conviction for a misdemeanor violation of a protection order will not qualify, even if the violation was committed by a violent act, if the statute does not require the use or attempted use of physical force or the threatened use of a deadly weapon. The U. S. Attorney's Office can determine which misdemeanor convictions qualify.</p><br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">In addition, the statute contains due process requirements regarding counsel and jury trials. Absent compliance with these due process requirements, the misdemeanor conviction will not qualify as a domestic violence conviction for purposes of Section 922(g)(9). Moreover, a person may be able to possess a firearm if the conviction has been expunged or set aside.</p><a title="id2357034" name="id2357034" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Transfer of Firearm to Person Convicted of a Misdemeanor Crime of Domestic Violence, 18 U.S.C. § 922(d)(9)<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">It is also illegal to transfer a firearm to a person convicted of a misdemeanor crime of domestic violence. A violation of Section 922(d)(9) must be knowing. Assistance in satisfying this requirement is provided by amendment of the Brady statement to require a purchaser of a firearm to state that he or she has not been convicted of a misdemeanor crime of domestic violence.</p><a title="id2357058" name="id2357058" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Official Use Exemption, 18 U.S.C. § 925<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">The official use exemption does <em>not</em> apply to Sections 922(d)(9) and 922(g)(9). This means that law enforcement officers or military personnel who have been convicted of a qualifying domestic violence misdemeanor will not be able to possess or receive firearms for any purpose, including the performance of official duties. Attorney and/or to the Alcohol, Tobacco & Firearm Office in your jurisdiction.</p><a title="id2357093" name="id2357093" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Penalties<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">The maximum term of imprisonment for a violation of Sections 922(d)(8), 922(g)(8), 922(d)(9), or 922(g)(9) is 10 years.</p><br />Other Relevant Statutes<a title="id2360277" name="id2360277" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Full Faith and Credit to Orders of Protection, 18 U.S.C. § 2265<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">This civil law provides that a civil or criminal domestic protection order issued by a court in one state or Indian tribe shall be accorded full faith and credit by the court of another state or tribe, and is to be enforced as if it were the order of the court of the second state or tribe. This law applies to permanent, temporary and ex parte protection orders that comply with the statute's requirements. To comply, the protection order must have provided the defendant with reasonable notice and an opportunity to be heard, in a manner consistent with due process. This law does not apply to mutual protection orders if (a) the original respondent did not file a cross- or counter-petition seeking a protective order or (b) if such a cross- or counter-petition was filed, but the court did not make specific findings that each party was entitled to such an order.</p><a title="id2360309" name="id2360309" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Amendment of the Brady Statement, 18 U.S.C. § 922(s)<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">The Brady statement requirements were amended as of September 30, 1996, to include a statement that the recipient of the firearm has not been convicted in any court of a misdemeanor crime of domestic violence. The Brady statement still does not require that the firearm recipient state whether he or she is currently subject to a valid protection order. The recipient will be compelled to fill out, at the time of receipt of the firearm(s), an ATF form requiring certification that he or she is not subject to a valid protection order.</p><a title="id2360335" name="id2360335" style="color: rgb(12, 115, 158); text-decoration: none; "></a>Right of Victim to Speak at Bail Hearing, 18 U.S.C. § 2263<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">The victim of a VAWA crime has the right, a right that need not be exercised, to be heard at a bail hearing with regard to the danger posed by the defendant. This statute prevents citizens or residents from using the residency process as a means to exert control over an alien spouse or child. This statute allows victims to remain in the United States independent of their abusive husbands/parents.</p><br />Conclusion<br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">The federal domestic violence statutes provide powerful weapons for U.S. Attorney's Offices around the country to assist state and local law enforcement in their fight against domestic violence. There must be proof that the stalking placed the victim in reasonable fear of death or serious bodily injury.</p><br /><p style="margin-top: 0px; margin-right: 0px; margin-bottom: 1em; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; "><em>Example: <u>United States v. Their beloved daughter, Julia Marie Keenan-Dawson would be found days later naked and left on the side of the road in a snowy pile for dead. Protection orders are suppossed to be in place to protect you; however not all offenders are picked up on violations and the response time for this from local Law Enforcement Departments is horrible. Nationwide Law Enforcement agencies are swarmed with continuing and over flowing personal protection orders (restraingin orders/injunctions). In 2006 alone more than 900,000 Domestic Violence cases went through the United States Court Systems. Think of how bad this is worldwide??? 65% of these cases were at the hands of some intimate or living with them or known to them. 75% of these cases were at the hands of men. Women make up 75% of the victims of homicides by an intimate partner. Women also make up 85% of the victims of non-lethal Domestic Violence. Black women suffer a 35% higher rate of Domestic Violence than white women. While altogether black women suffer a 22% higher rate of violence amongst all races. Black males are at a 62% higher rate of being abused than a white male. Domestic violence is primarily prominent among women ages 16 to 24. Low to middle class women are dominating this alarming and escalating rate. Divorced and seperated couples seem to fund this victimization, followed by non-married) couples. This will not only help elminate some of the court case loads with "violations" as well as help to keep personal protections in order. It will also keep an acrual record of the offenders daily tasks and if they are accused of the crime, the records can be pulled to see if they truly did violate it. Yes, it may cost more money, however we already allow people who are Sex Offenders and Parolees to wear ankle bracelets, so why not add in one more category? Isn't safety a priority to us? I have spoken with a few people on this who do not agree and they tell me, "it's a civil rights violation for having them wear an ankle bracelet." Well, it's a violation of our rights to be abused and live in fear. And yes you loose your RIGHTS when you go to jail. This is a known fact among those of us who were convicted of a crime.
